DUI Ticket For A Passenger. What !!?

Client called today to ask why her rate went up like %200. Well I told her let me check to see if she had any tickets…then she said she got a DUI while she was a passenger with her friend. Well thats a good reason for a major rate increase.

The story did not make sense. Can she get a DUI ticket while you are a passenger ?

    In a few states you could get a dui for being outside a vehicle with the keys in the ignigion in your driveway sitting on the porch listening to your buddys radio if they were drunk.

    Yes, passangers can get duis.

    I had a policy holder get a dui in a private parking lot of a bar. as he was leaving the bar, he got in his truck, put the keys in the ignition, and was charged with a dui before the vehicle pulled ever moved.

    but I never heard about someone in the passenger seat getting a dui.. that’s new to me. wow!

    I have a lot of cop clients, if the keys are in the ignition, it shows intent to drive, therefore, your busted.

    If you want to pass out in your car, shut off the car and take the keys out of the ignition and you should be OK, in relative terms.

    Keys in the ignition, shows you may have been driving and passed out. Seen a guy that passed out at a light, but somehow mannaged to keep his foot on the brake, car running, still in gear….

    The passeneger one is unusual, maybe thats a Cali thing…

      Doesn’t pass the smell test for me. I bet she misunderstood or is lying. Wouldn’t a cop WANT the drunk person to be the passenger? That’s what a DD is for. Unless he saw her grabbing at the steering wheel or something and they were both drunk?

        I was referring to anyone in the friggin drivers seat.

        I have never heard of a passenger getting a DUI.

        Now what a cop will do, if the driver is drunk, and the passenger is sober, book the driver, and let the passenger take the car home, but if the passenger is drunk and gets in the drivers seat, well, they are stupid, and just got popped for the DUI.

    I think your all overthinking this…The carrier found out about a ticket…The ticket was issued, unless police officers are going around and issueing tickets illegally what can you do….I also agree there is something wrong with a passenger getting a DUI.

    Dan its Driving Under the influence or Driving while Intoxicated..Well it will destroy your driving record for the insurance purpose.

    That’s my point…I’ve never heard of it either. Look at the first post though…that’s what his client is saying happened. I’m as dumbfounded as you.
